When using any of the 365 Healthy By Choice Blockchain (365 HBC), services you are agreeing to the following conditions in full.
For the purpose of these terms, 365 Healthy By Choice Blockchain. will be referred to as the “company” and all users of the company’s services shall be referred to as the “customer”. The website is operated by 365 Healthy By Choice Blockchain at www.365healthybychoice.com will be referred to as the “website”.
Ethereum (ETH) is not backed or value guaranteed by any financial institution; when purchasing Ethereum (ETH)s the customer assumes all the risk that the Ethereum (ETH)s may become worthless in value. Customers should research and consider the risks before purchasing any Ethereum (ETH)s. The company makes absolutely no guarantee about the future value of the Ethereum (ETH)s purchased.
Customer input errors
It is the sole responsibility of the customer to check the accuracy of information entered and saved on this document. Account details displayed on the order summary Members fill in form will be the final transfer destination. In the case that this information is incorrect, and funds are transferred to an unintended destination, the company shall not reimburse the customer and shall not transfer additional funds. As such customers must ensure the Metamask address is correct.
Must own the Ethereum (ETH) address
The customer must send their Ethereum (ETH) payments to the company from an address owned by the customer. The company may need to refund the Ethereum (ETH) payment, such as if the Metamask address is incorrect and customer cannot be contacted. The company will accept no responsibility or issue any compensation if the customer is unable to access Ethereum (ETH) refund due to sending their initial payment from a shared/online wallet.
If the company receives payment for an order that has already expired, the company reserves the right to recalculate the Ethereum (ETH) to United State (USD) exchange rate at the time of processing the transfer to the customer. This may result in the customer receiving less Ethereum (ETH)s or United States Dollar than the original ordered amount.
The company requests that no customer completes payments for expired orders, but instead places a new order at the time of their payment.
If the customer pays less than the payment amount for their order and the order expiration time has passed, the company reserves the right to either:
- a) Cancel the order and refund the payment amount
b) Recalculate the order totals based on the payment amount received and the current Ethereum (ETH) exchange rate
It is the customers responsibility to send the correct payment amount, if the customer sends an amount greater than the amount specified on the order, the company will process the order at the original amount specified on the order. The amount of over-payment will not be considered in the order and will not be refunded.
Invalid customer details
The company reserves the right to cancel and refund any orders with false, or seemly false, customer information, including incorrect or invalid name, address, nationality or ID numbers.
The company reserves the right to contact the customer to request additional information related to their identity or source of funds, if the company considers the order to appear suspicious.
When legally obligated, the company will provide customer information to the South African government agencies upon legal request, court order or presentation of warrant.
The customer agrees to indemnify, defend and hold harmless intention to the company, its affiliates and its distributors and their respective owners, investors, contractors, officers, directors, members, managers, partners, shareholders, licensors, suppliers, customers, employees, agents, third-party advertisers, technology providers and service providers from and against any loss, damage, cost, or liability (including, reasonable attorneys’ fees) resulting from or relating in any way to a third-party claim, demand, action or proceeding that arises out of this Agreement or the Website, including but not limited to in relation to: (a) your use, non-use or misuse of, or connection to the Website, the Services and any Content (including without limitation your Content and any third party Content) forming part of the Website;
Anti-Money Laundering (AML)
It is expressly prohibited for the customer to utilize their account for the purpose of clearing money, hiding money or in any way attempting to obscure the source of funds or attempting to circumvent financial regulations or restrictions.
The company will actively analyse customer account activity for any signs of money laundering; any customer whom, in the opinion of the company, has the appearance of involvement in money laundering activities will have their account terminated.
Any customer holding citizenship, permanent residency or who has been a tax resident in a Country that finds this form of marketing illegal will be prohibited from using any of the services provided by the company.
365 Healthy By Choice holds the right to charge additional transactional fees for the purchase of products, devices, training courses or lots should you not have a cryptocurrency wallet. The transactional fees will be based on a percentage between 6 % – 12 % depending on the amount deposited into our bank account.
365 Healthy By Choice holds no responsibility for the loss of seed phrase words, privacy keys or password for Metamask personal account. When setting up all the Metamask address it is the customers responsibility to save the seed phrase, privacy key or any password to a document for safe keeping. 365 Healthy By Choice will provide you with assistance to save these passcodes as they are extremely sensitive documentation and cannot be lost. Member Metamask wallets will be created by a 365 Healthy By Choice member to load them onto the blockchain and help with retractions for packages purchased.
Standard Operating Procedure after Lot purchase
The customer must retract the $200 from each Lot purchased (Airdrop 1) immediately and send it to 365 HBC Metamask to go towards purchasing one of the following 365 Healthy By Choice products, services, devices, training, practices or franchises together with $50 per lot for the 365 HBC platform (Master White Label, Admin, IT and Operations);
- Health Consultations with Quantum Scans from 365 HBC Practitioners.
- Food State Nutrients at 365 HBC Centres/Retailers/Stockists/Affiliates.
- 365 HBC Scanning Devices and Quantum Health Discs
- Affiliate and Stockist Food State Nutrient products, devices and training courses.
- Advanced NPQ Certified Health / Business / Agriculture training courses.
- 365 HBC Franchise options
- 365 HBC Practitioner and Health Advisor business set up
- 365 HBC Start up and Manage your Business

Product/Device/Advanced Training Purchasing
Each customer order will be emailed to 365 HBC indicating the products /consultations /devices /discs /advanced training courses required. The customer’s Payment must reflect in 365 HBC accounts alongside the emailed Proof of Payment and Full Retraction transaction number for the order to be released. 365 HBC will not give any Products / Service / Devices / Discs/ Training courses without payment and full retraction.
Once the Proof of Payment has been acknowledged, 365 Healthy By Choice will provide you with a specific coupon code to be able to purchase your order for Food State Products /Devices /Consultations /Advanced Training online. This coupon will only work once.
The coupon provided will deduct the paid retraction for the applicable Lots allocated to products and services, i.e., Food State Products /Devices /Discs /Consultations /Advanced Training.
There are additional costs which the costumer needs to consider.
On the website the coupon will only discount the purchased Product /Device /Consultation /Advanced Training of Lot package.
The costs may include: VAT/GST, Delivery / Shipping fee and/or customs duty(if applicable).
After Product Purchase
No product returns will be accepted or exchanged due to sanitary reasons.
Lot volumes will dictate the mark-up received by the type of buyer (Blockchain Customer, Affiliate/Stockist, Retailer or Franchise owner).
Practitioners/Health Advisors/Affiliates/Stockists/Franchises are permitted to sell to Non-Blockchain end users who pay full retail price for products and services (100%). See the current Product Price List for more information. There is one retail exit price for products and services, with blockchain prices offered to members only (less 5% to 30%), and this exit price cannot be negotiated. This means that the same exit price will be offered to end users by retailers /sole practitioners, practitioner practices, franchises, affiliates and stockists selling Products /Devices /Consultations /Advanced Training courses. Affiliates and Stockists who sell to retailers and practitioners will have to adjust their margins according to the type of customer and the fixed exit price.

Consultations conducted by a 365 Healthy By Choice Practitioners/Health Advisors or purchased by 365 HBC registered businesses owning practices will need the following;
Clients all sign and complete Indemnity and Client Intake forms which carries the client’s 365 HBC universal account number. These forms must be emailed to 365 HBC head office weekly by close of business on Friday/Saturday on clientintake@365HealthyByChoice.com. Failure to do so will result in a fine of $1 000 and suspension of the licence to operate as a 365 HBC Practitioner/Health Advisor.
All practitioners and health advisors must sign the indemnity forms and take out appropriate personal and practice insurance. They will need to send the proof of insurance to 365 HBC. Failure to do so will result in a fine of R10 000 and suspension of the licence to operate as a 365 HBC Practitioner/Health Advisor.
365 Healthy By Choice will not be liable for malpractice or Incidences caused by Practitioners/Health Advisors.
365 HBC Devices may be purchased by 365 HBC approved registered businesses wanting to set up practices with qualified operators and by qualified Practitioners/Health Advisors setting up their own practices.
Should your Device have manufacturing issues, 365 Healthy By Choice will assist in the return to the manufacturer for repairs, however the 365 Healthy By Choice will not be liable for repair costs nor delivery cost to 365 HBC and to the manufacturers. The device has a 1 (one) week warranty period during which time the manufacturer needs to be notified in writing of any defects or malfunctioning. Should it be found that issues with the device are due to any tampering / negligence / misuse, the customer will be liable for the cost of repair.
The Q450, SCIO and Eductor must be purchased via retractions to 365 HBC Metamask account. Thereafter it may be collected or will be delivered to the customer. The customer will load the software onto the computer following the manufacturers’ instructions in the instruction booklet. Additional expenses are for the customers’ account as mentioned earlier in this document.
The Q450 Health Scanner training for the Q450 is via the Beginner’s Manual provided with the device and operators will be required to pay, complete and pass (80%) the 365 HBC advanced course within 3 months of purchase.
The Quantum SCIO and EDUCTOR training is, firstly, via the Quantum Inventor’s on-line university and will be paid for by the applicants, currently 650 EUR. This will certify the operator internationally. Thereafter, 365 HBC requires operators to pay and complete the 365 HBC advanced health and quantum courses within 3 months of purchase, attend and pass (80%) quantum on-line and virtual classroom training.
There will be weekly live on-line training covering devices, products and diseases offered by 365 HBC.
Appointment 365 HBC Practitioners/Health Advisors
365 HBC reserves the right to accept or refuse applications for Businesses, Practitioners and Health Advisors without explanation. All businesses/practitioners/health advisors must provide 365 HBC with proof of their professional qualifications and the professional bodies with whom the quantum device operators are registered. The practitioner/health advisor will be required to sign up as a member, or in the case of a non-BC member need to be assigned to a responsible team member under whom they are working who is fully accountable, with 365 HBC globally.
Practitioners will require a medical or health degree or diploma and charge $200 per consultation per hour or part thereof. Health advisors will require final year school levers’ certificates and a completion of a certified Anatomy and Physiology course approved of by 365 HBC. Health advisors will be permitted to charge the full rate of $200 per client and offer the client 2 free 1-hour vouchers, depending on their qualification level. This ensures a consistent consulting/coaching payment structure globally.
Once registration is approved successful applicants will be offered registration with the 365 HBC professional practitioner/health advisor member group and may purchase and operate the quantum devices.
365 HBC Practitioners / Health Advisors/ Centres / Franchises will be required to monthly track each client scan when using the assessment devices and other designated equipment/services depending on the structure of the business, using company software (currently under development) and pay a percentage to 365. In the set-up phase, each practitioner / Health Advisor / Business will be required to order and send retraction lots of $200 plus $20 each to the 365 HBC Metamask depending on Lot orders. The software will result in a monthly fee being paid for the use of the tracking, security and billing of the practice. These documents are drawn up as agreements and are separate from the standard operating procedure which outlines the operating systems. Monthly percentages charged will depend on Lot sizes purchased regularly, practice/franchise size, number of products ordered.
The purchase of Lots will offer entry level Nutrition, Detoxification, Immunity and Lifestyle free NPQ courses (currently pending), which will need to be completed by the Practitioners/Health Advisors in the first 3 months of receiving their registration and device to practice as a 365 HBC operator. All operators will be required to purchase and pass the advanced training courses to upgrade their skills and knowledge to include the advanced health and business courses and to attend 80% of the live webinar training offered by 365 HBC in the first 6 months of practice. Each Practitioner and Health Advisor will be required to send in 20 complete case studies over a 3-month period to 365 HBC within 4 months of receiving registration and the device and complete the 365 advanced health courses. SCIO and EDUCTOR practitioners will need to complete the inventor’s on-line certified quantum course within 6 months of receiving their device.
12 Month 365 Health Package
Clients who want to purchase the 12 Month 365 Health Package will pay a once off $3500. 365 HBC will provide the client with 12 x SCIO 1-hour consultations and 12 x boxes (3 +1) products per 12-month period.
Any member of the family/friend, with the owner’s permission in writing sent to 365 HBC, may use the consultations and/or purchase products Lots. No unused consultations or products may carry over to the next 12-month period.
The client may repeat the purchase of 365 HBC 7 lots annually.
365 HBC Practices of up to 3 Practitioners
All 365 HBC Practices need to sign onto the 365 HBC security and billing software. Customers choosing to become a 365 HBC Practice must sign the 365 Practice agreement which will be provided by 365 Healthy By Choice.
365 HBC Franchises of more than 3 Practitioners
All franchises need to sign onto the 365 HBC security and billing software. Customers choosing to become a Franchisee must sign the 365 Franchise agreement which will be provided by 365 Healthy By Choice, once the Franchisee level has been determined, i.e., local, area, regional and country Franchisee.
